1. About this policy

APW Finance Pty Ltd (“APW Finance”, “we”, “us”, “our”) provides credit assistance as a mortgage and finance broker. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and by Part IIIA of that Act where credit information is involved.

This policy explains what personal information we collect, why we collect it, who we share it with, and what you can do about it. It applies to our website at https://apwfinance.com and to every dealing you have with us.

2. What we collect

To assess your position and approach lenders on your behalf, we collect:

  • Identity information – name, date of birth, residential address, contact details, and identification documents such as a driver licence or passport.
  • Financial information – income, employment details, assets, liabilities, living expenses, bank statements, tax returns, business financial statements and BAS.
  • Credit information – your credit history, existing loans and repayment conduct, and information from credit reporting bodies.
  • Transaction information – details of the property, vehicle or business asset you are financing.
  • Website information – pages visited, time on site, referring source, device and browser type, and IP address.

We only collect what we reasonably need to provide credit assistance or to meet a legal obligation. If you choose not to provide something, we may be unable to help you.

3. How we collect it

Directly from you, in most cases – through our enquiry forms, calculators, phone calls, email and meetings. We may also collect information from your accountant, your employer, a referrer, a lender, an insurer, a credit reporting body, or from publicly available sources, where you have authorised that or where the law permits it.

4. Why we collect it

  • To assess what you can borrow and which lenders suit your circumstances.
  • To prepare and lodge a credit application on your behalf.
  • To meet our obligations under the National Consumer Credit Protection Act 2009, including the responsible lending and best interests duty obligations.
  • To verify your identity under anti-money laundering and counter-terrorism financing law.
  • To manage our relationship with you, including loan reviews after settlement.
  • To respond to enquiries and to send you information you have asked for.

5. Who we share it with

We disclose your personal information to:

  • Lenders and credit providers on our panel, when submitting or supporting an application.
  • Lenders mortgage insurers and other insurers, where mortgage insurance or a related policy is required.
  • Credit reporting bodies, and we may obtain a credit report about you from them.
  • Valuers, conveyancers, solicitors, accountants and settlement agents involved in your transaction.
  • Service providers who support our business, including IT, hosting, CRM, email and marketing platforms.
  • Government agencies, regulators and courts, where required or authorised by law.

We do not sell your personal information, and we do not disclose it for another party’s direct marketing without your consent.

6. Credit reporting

Where we arrange credit for you, credit reporting bodies may collect and hold credit information about you, including applications you make and your repayment history. Those bodies may include Equifax, illion and Experian. Each publishes its own credit reporting policy on its website, explaining how it manages credit information, how to access it, and how to correct it.

You can ask a credit reporting body not to use your credit information for pre-screening a direct marketing offer, and you can ask it not to use or disclose your information if you believe you have been or are at risk of being a victim of fraud.

7. Overseas disclosure

Some of the service providers we use may store data outside Australia, including in United States for email, hosting and CRM platforms. Where that happens we take reasonable steps to ensure the recipient handles your information consistently with the Australian Privacy Principles.

8. Our website

Cookies. Our site uses cookies to keep the site working, remember your preferences and understand how the site is used. You can disable cookies in your browser, though parts of the site may stop working properly.

Analytics and advertising. We use  Google Analytics, Google Ads, Meta Pixel to understand site usage and to measure advertising. These tools may set their own cookies and collect device and usage data under their own privacy policies.

Calculators. The calculators on our site are supplied by Vision Abacus and are embedded from visionabacus.net. Figures you enter are processed by that tool. Results are estimates only and do not constitute credit assistance or an offer of credit.

Third-party links. Our site links to other websites. We are not responsible for their content or their privacy practices.

9. How we protect your information

We hold your information in secure electronic systems and, where paper records exist, in secure storage. We restrict access to staff who need it to do their job. We take reasonable steps to protect information from misuse, interference, loss and unauthorised access, but no system can be guaranteed secure.

10. How long we keep it

We retain your information for as long as we need it for the purposes set out above, and for at least seven years after your last dealing with us, to meet our record-keeping obligations under credit and anti-money laundering law. After that we destroy or de-identify it.

11. Accessing and correcting your information

You can ask for a copy of the personal information we hold about you, and you can ask us to correct it if it is wrong, out of date or incomplete. Contact us using the details below. We will respond within 30 days. There is normally no charge, though we may charge for retrieving records where the request is substantial.

In limited circumstances we may refuse access, for example where giving it would unreasonably affect another person’s privacy. If we do, we will explain why in writing.

12. Complaints

If you think we have mishandled your personal information, contact our Privacy Officer first using the details below. We will acknowledge your complaint promptly and aim to resolve it within 30 days.
